Existeixen les seg\u00fcents cl\u00e0usules abusives:<\/p>\n<ul>\n<li>La cl\u00e0usula terra: que es la que permet que el banc estableixi un l\u00edmit m\u00ednim per la qual el inter\u00e9s no podia baixar.<\/li>\n<li>El IRPH: que suposava tenir que pagar un 4% d&#8217;inter\u00e8s durant tota la vida del pr\u00e9stec i que habitualment est\u00e0 inclosa en els pr\u00e9stecs realitzats per Caixa Banc.<\/li>\n<li>La comissi\u00f3 d&#8217;apertura: que \u00e9s una comissi\u00f3 d&#8217;apertura que es pagava al banc per a que conced\u00eds la hipoteca.<\/li>\n<li>La cl\u00e0usula de comissi\u00f3 per reclamaci\u00f3 d&#8217;impagat: que s&#8217;aplica davant el retr\u00e0s del pagament de la quota i que suposa autom\u00e0ticament 35.000 euros de comissi\u00f3, encara que nom\u00e9s hagi transcorregut un sol dia d&#8217;impagament.<\/li>\n<li>La cl\u00e0usula d&#8217;imposici\u00f3 de les despeses del pr\u00e9stec: que suposa que el client ha de pagar totes les despeses derivades de notaria, registre, gestoria i taxaci\u00f3, quan aquestes despeses les ha de satisfer \u00edntegrament el banc, amb l&#8217;excepci\u00f3 de les despeses de notaria que van a mitges entre el banc i el client.<\/li>\n<li>La cl\u00e0usula del venciment anticipat: que possibilitaba al banc donar per ven\u00e7ut tot el pr\u00e9stec per l&#8217;impagament d&#8217;una sola quota.<\/li>\n<li>Aplicaci\u00f3 d&#8217;interessos de demora del 19, 20 o 21%.<\/li>\n<\/ul>\n<p>La recomanaci\u00f3 es que tots aquells que tinguin pr\u00e9stecs hipotecaris, acudeixin a l&#8217;advocat de la seva confian\u00e7a per a que els hi revisin les escriptures i poder comprovar si existeixen o no cl\u00e0usules abusives per tal de reclamar-les.<\/p>\n<p>Si voleu tenir m\u00e9s informaci\u00f3 sobre les cl\u00e0usules abusives, podeu accedir al seg\u00fcent enlla\u00e7: <a href=\"https:\/\/ott.instantvideocloud.net\/lleidatv\/ca\/f\/b288f6f0-bced-4e4d-8ba4-e8e974c4df8c\/v\/111a5949bc\/72b09b40-1835-8a7b-c5ff-d6424b2d6788\" target=\"_blank\" rel=\"noopener\">cl\u00e0usules abusives<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La majoria de les escriptures hipotecaries tenen cl\u00e0usules abusives que imposen unilateralment els bancs i que poden ser perjudicials pel client, per\u00f2 que si es reclamen, aquest ho pot recuperar.
